1. Terms and definitions
“Provider” — Top5Top10 LLC, INN 7702738264, OGRN 1107746628440, registered address: 107031, Moscow, Rozhdestvenka st., bld. 20/8, b. 5, premises II.
“Customer” — a legally capable individual (18+) or a legal entity / sole proprietor that has accepted this Offer.
“Service” / “Software” — the Prompt Page software platform available at https://promptpage.site and related subdomains, providing the Customer with AI-powered tools for building and publishing websites.
“Personal Account” — the section of the Service accessible to the Customer after authentication, used to manage the plan, AI-credit balance and projects.
“Plan” — a service bundle with a fixed price and feature limits, published at https://promptpage.site/pricing.
“AI credits” — the Service's accounting unit for charging AI usage; 1 credit ≈ 1 RUB for referral payouts.
“YuKassa” — the payment service operated by YuMoney NCO LLC, INN 7750005725, Bank of Russia license No. 3510-K.
2. Subject of the Offer
The Provider undertakes to grant the Customer access to the Service on the terms of the selected Plan, and the Customer undertakes to pay for the services in the manner and amount set by the Offer and the pricing page.
Access services are deemed properly and fully rendered upon activation of the corresponding Plan in the Personal Account and provision of technical capability to use the Service, unless the Customer submits a reasoned claim within 3 (three) calendar days of that date.
3. Acceptance procedure
Acceptance under Art. 438 of the Civil Code of the Russian Federation requires the cumulative actions of the Customer:
— registration of an account on the Service with email confirmation;
— review of this Offer and the Privacy Policy (confirmed by ticking “I accept the terms” at registration);
— payment for the selected paid Plan or AI-credit pack via YuKassa.
Once funds are credited to the Provider's settlement account, the agreement is deemed concluded on the terms of this Offer.
4. Service price and payment procedure
The price is determined by the selected Plan and published at https://promptpage.site/pricing. All prices are in Russian rubles (RUB) and include VAT where required by Russian law.
Payment is made via the YuKassa payment service. Available methods: MIR, Visa, Mastercard payment cards (Russian and foreign); Russian Faster Payments System (SBP); YuMoney e-wallets; online banking (Sberbank Online, Tinkoff, etc.); SberPay; T-Pay; mobile carrier billing.
Payment is considered made at the moment funds are credited to the Provider's settlement account as confirmed by a YuKassa webhook notification.
Subscription is paid in advance for 1 (one) calendar month. Automatic renewal is not implemented in the current version — the Customer pays for the next period before the current one expires.
The Provider may unilaterally change Plan prices. New prices take effect upon publication on the pricing page and do not apply to periods already paid.
5. Electronic fiscal receipt (54-FZ)
Under Federal Law No. 54-FZ of May 22, 2003 “On the Use of Cash Register Equipment…”, when paying for services the Customer is issued an electronic fiscal receipt sent to the email address specified at payment.
The receipt is issued by YuKassa (acting as the fiscal data operator transmitting data to the Russian Federal Tax Service).
If the receipt does not arrive within 24 (twenty-four) hours, contact support@promptpage.site for re-delivery.
6. AI credits and top-up packs
Upon successful Plan payment, AI credits are credited to the Customer's balance in the amount specified in the Plan description.
AI credits credited under a subscription do not expire and remain on the balance indefinitely until fully consumed or the agreement is terminated.
The Customer may additionally purchase AI-credit packs in the Billing section of the Personal Account. The price of packs and the number of credits are shown at the moment of purchase.
7. Refunds
Refunds are processed in accordance with Art. 32 of the Russian Consumer Rights Protection Law and Federal Law No. 173-FZ “On Currency Regulation and Currency Control”.
The Customer may withdraw from the services and request a refund subject to reimbursement of the Provider's actually incurred costs: the value of consumed AI credits and bank/acquiring fees (no more than 3% of the payment amount).
A refund request is sent to support@promptpage.site stating: payer's full name, account email, payment date and amount, YuKassa payment ID (if available), and the reason.
The request is reviewed within 10 (ten) business days of receipt. The refund is made using the same method as the original payment (to the same bank card/account) within 10 (ten) business days from the refund decision — within the terms set by YuKassa and the issuing bank.
Refunds are not made: upon material breach of the Offer by the Customer; in confirmed cases of fraud; for periods exceeding 14 (fourteen) calendar days from payment if more than 20% of the paid period's AI credits have been used.
8. Term and termination
The agreement is in force from the moment of acceptance until termination on one of the following grounds: the Customer's refusal of services (subscription cancellation in the Personal Account); unilateral termination by the Provider for breach of the Offer by the Customer; discontinuation of the Service with notice to the Customer at least 30 (thirty) calendar days in advance.
If the Customer cancels the subscription, access to paid features is retained until the end of the paid period.
9. Rights and obligations of the parties
The Provider undertakes to: grant access to the Service in the scope of the paid Plan; ensure the confidentiality of the Customer's personal data under the Privacy Policy; notify of material changes at least 7 (seven) days in advance.
The Provider has the right to: suspend services in case of breach of the Offer by the Customer; temporarily restrict access for technical maintenance; modify Service functionality while preserving the core characteristics of the Plan.
The Customer undertakes to: pay for services in a timely manner; not use the Service for unlawful purposes (generation of prohibited content, infringement of third-party rights, fraud, spam); not share credentials with third parties.
The Customer has the right to: receive services in the scope of the paid Plan; contact support; refuse services in the manner set out in sections 7 and 8 of the Offer.
10. Liability of the parties
For non-performance or improper performance of obligations, the parties bear liability under Russian law and this Offer.
The Provider makes reasonable efforts to ensure uninterrupted operation of the Service (target SLA — 99% availability per month). If the permissible downtime is exceeded, the Customer may request a pro-rata refund.
The Provider's total liability under the agreement is limited to the amount paid by the Customer for services in the 12 (twelve) calendar months preceding the event of liability.
The Provider is not liable for: the content of websites created by the Customer; the quality and accuracy of AI generation; impossibility of providing services for reasons beyond the Provider's control (force majeure, third-party actions, ISP failures, AI provider failures, YuKassa).
11. Confidentiality and personal data
Processing of the Customer's personal data is carried out under 152-FZ “On Personal Data” and the Privacy Policy published at https://promptpage.site/privacy.
The parties undertake not to disclose to third parties confidential information that became known to them in the course of performing the agreement, except as required by Russian law.
12. Changes to the Offer
The Provider may unilaterally amend this Offer with the new version published at https://promptpage.site/oferta.
Material changes take effect no earlier than 7 (seven) calendar days after notification to the Customer by email or in the Personal Account. Already paid periods are served under the previous terms.
Continued use of the Service after the changes take effect constitutes the Customer's consent to the new version.
13. Governing law and dispute resolution
The relationship between the parties is governed by the law of the Russian Federation.
All disputes are subject to pre-trial (claim) settlement: the claim response period is 30 (thirty) calendar days from receipt.
If no agreement is reached, disputes are heard: with individuals — by the court at the Customer-consumer's place of residence (or another at the Customer's option); with legal entities and sole proprietors — by the Moscow Arbitration Court at the Provider's location.
